These Terms & Conditions apply to your use of the SeaBreathes application, website and associated SeaBreathes services.

SeaBreathes is operated by Jamie Attoe, trading as SeaBreathes, in the United Kingdom.

By accessing or using SeaBreathes, you agree to these Terms. If you do not agree to them, please do not use SeaBreathes.

These Terms do not affect any rights you have under applicable consumer law that cannot legally be excluded or restricted.

1. About SeaBreathes

SeaBreathes provides guided breathing, relaxation and sensory experiences intended for general wellbeing.

SeaBreathes combines breathing guidance with elements such as sound, rhythm, voice, silence and visual movement.

SeaBreathes is not a medical service, healthcare provider or emergency service and is not intended to diagnose, treat, cure or prevent any disease or medical condition.

2. Using SeaBreathes safely

Breathing exercises affect people differently.

Use SeaBreathes in a comfortable and safe environment. Never force yourself to follow a breathing pace, depth, breath hold or technique that feels uncomfortable.

If a suggested breathing pattern does not feel comfortable, return to your normal breathing.

Stop an exercise if you experience dizziness, pain, unusual shortness of breath, significant discomfort or otherwise feel unwell.

If you have a medical condition, are pregnant, have respiratory or cardiovascular concerns, or are uncertain whether a particular breathing practice is appropriate for you, seek advice from an appropriately qualified healthcare professional.

Do not use guided SeaBreathes sessions while driving, operating machinery, swimming or undertaking any other activity where distraction or deliberate changes to your breathing could create a safety risk.

In an emergency, contact the appropriate emergency service. Do not rely on SeaBreathes for emergency assistance.

3. No medical advice

Information, guidance and experiences provided through SeaBreathes are for general wellbeing and informational purposes.

Nothing provided through SeaBreathes constitutes medical advice, diagnosis or treatment or should replace advice, diagnosis or treatment from a suitably qualified healthcare professional.

Research discussed by SeaBreathes relates to breathing practices and associated areas of research. It should not be interpreted as clinical validation of the SeaBreathes application itself.

4. Free and Full experiences

SeaBreathes may make a selection of experiences, functionality or content available free of charge.

Additional content or functionality may be available through an optional Full unlock.

The SeaBreathes Full unlock is intended to be offered as a one-time purchase and not a recurring subscription.

Purchasing Full does not automatically enrol you in any future subscription.

If SeaBreathes introduces other optional paid products or services in the future, their price and payment arrangements will be clearly presented separately before purchase.

SeaBreathes may develop and improve over time. Content and functionality may therefore be updated, replaced, added or removed where reasonably necessary, subject to your applicable consumer rights.

5. Purchases and payment

Purchases made within the SeaBreathes application are processed through the applicable app-store provider, such as Apple or Google.

The price applicable to you will be displayed before you confirm a purchase and may vary according to country, currency, taxes and app-store pricing.

Your purchase may also be subject to the relevant app store's payment, purchasing and refund terms.

Where payment is processed by an app store, SeaBreathes does not directly receive or store your complete payment-card details.

Nothing in these Terms removes or limits any refund, cancellation, repair, replacement, price-reduction or other mandatory consumer right available to you under applicable law.

6. Digital content and cancellation rights

The Full unlock provides digital content or functionality that may become available immediately following a successful purchase.

Your rights relating to cancellation, refunds and digital content depend on applicable law and the purchasing process provided by the relevant app store.

Where the law requires your express consent before digital content is supplied during a cancellation period, and acknowledgement that a cancellation right may consequently be lost, those requirements must be satisfied through the applicable purchasing process.

These Terms do not, by themselves, treat you as having waived a statutory cancellation right merely because you use SeaBreathes or purchase the Full unlock.

If digital content is faulty, materially different from its description or otherwise fails to conform to applicable legal requirements, you may have statutory remedies. Nothing in these Terms limits those rights.

7. Restoring purchases

Where supported by the relevant app store and platform, previously purchased Full access may be restorable using the account associated with the original purchase.

Purchase restoration is subject to the systems and rules of the relevant app-store provider.

8. Licence to use SeaBreathes

Subject to these Terms, SeaBreathes grants you a personal, limited, non-exclusive, non-transferable and revocable licence to use the application for lawful personal, non-commercial use.

Purchasing the Full unlock gives you access to the applicable Full functionality under this licence. It does not transfer ownership of SeaBreathes, its software or its intellectual property to you.

Your use of an application downloaded through Apple or Google may additionally be subject to the applicable platform's terms and licence conditions.

For applications distributed through Apple's App Store, Apple's applicable standard end-user licence terms may also apply.

9. Acceptable use

You must not intentionally:

• use SeaBreathes unlawfully;

• misuse or interfere with the normal operation or security of SeaBreathes;

• attempt to circumvent payment, purchase or access controls;

• attempt to gain unauthorised access to SeaBreathes systems;

• reverse engineer or modify SeaBreathes except where applicable law expressly permits this;

• reproduce, redistribute, sell or commercially exploit protected SeaBreathes content without permission; or

• use SeaBreathes in a way that infringes the rights of SeaBreathes or another person.

Nothing in this section restricts activities that applicable law expressly permits.

10. Intellectual property

SeaBreathes branding, original written material, guided experiences, graphics, artwork, audio, software, designs and other original content may be protected by copyright, trade mark and other intellectual-property rights.

Except where otherwise stated, those rights belong to SeaBreathes or the relevant rights holder.

Third-party materials remain the property of their respective owners.

Permission to use SeaBreathes does not transfer ownership of any SeaBreathes intellectual property to you.

11. Privacy

Your use of SeaBreathes is also subject to the SeaBreathes Privacy Policy.

SeaBreathes is designed with data minimisation in mind.

Where application preferences or progress are stored locally on your device, removing the application, clearing its data, changing device or other device-level actions may result in that information being lost.

The Privacy Policy provides further information about how personal information is handled.

12. Third-party platforms and services

SeaBreathes may rely on limited third-party technology and services, including services supplied by Apple, Google, device operating systems and app stores for application distribution, purchasing and related functionality.

Third-party services may be governed by their own terms and privacy policies.

SeaBreathes does not control third-party platforms and cannot guarantee their continuous availability.

Nothing in this section excludes responsibility that cannot lawfully be excluded.

13. Updates, availability and compatibility

We aim to keep SeaBreathes available and functioning reliably, but uninterrupted or error-free operation cannot be guaranteed.

SeaBreathes may receive updates that modify, improve, add, replace or remove functionality.

Changes to devices, operating systems, app stores, security requirements and third-party technology may affect compatibility or availability.

We may modify, suspend or discontinue functionality where reasonably necessary for technical, security, legal or operational reasons.

Where applicable, this is subject to your mandatory consumer rights.

14. Results and wellbeing outcomes

People respond differently to breathing, relaxation and sensory experiences.

SeaBreathes does not guarantee that using the application will produce a particular relaxation, sleep, focus, stress, emotional, health or wellbeing outcome.

Descriptions such as calm, focus, reset, relaxation or similar terms describe the intended character or purpose of an experience. They are not guarantees of a particular result or medical claims.

15. Responsibility and liability

You are responsible for deciding whether a SeaBreathes experience is appropriate for your circumstances and for following the safety guidance provided.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or restricted.

Nothing in these Terms affects statutory rights or remedies available to consumers.

Subject to those protections, SeaBreathes does not guarantee uninterrupted availability or that every experience will produce a particular personal or wellbeing outcome.

16. Ending your use

You may stop using SeaBreathes at any time and may uninstall the application from your device.

We may restrict access where reasonably necessary to protect SeaBreathes, its users, our rights or third parties, maintain security, comply with law or respond to serious misuse.

Any such action remains subject to applicable consumer rights.

17. Complaints and support

If you have a question, complaint or problem with SeaBreathes, please contact us using the details in section 20.

We will consider complaints and aim to respond within a reasonable time.

If your complaint concerns payment, billing or a purchase processed by an app store, you may also need to contact the relevant app-store provider through its applicable support or refund process.

This does not affect any statutory rights you may have against SeaBreathes.

18. Changes to these Terms

We may update these Terms where SeaBreathes develops or where legal, technical, security or operational requirements change.

The Last updated date at the top of this page identifies the current version.

Where required by applicable law, we will provide appropriate notice of material changes.

Changes to these Terms do not retrospectively remove rights that you have already acquired.

19. International availability and governing law

SeaBreathes may be made available internationally.

These Terms are governed by the laws of England and Wales, subject to mandatory consumer protections that may apply in your country of residence.

If you are a consumer living outside England and Wales, you may benefit from mandatory rights and protections provided by the laws of your country or region.

Nothing in these Terms is intended to deprive you of protections that cannot lawfully be excluded.

Nothing in this section prevents you from exercising any right to bring proceedings in a court or jurisdiction available to you under mandatory applicable consumer law.

21. General terms

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will apply only to the extent permitted by law, and the remaining provisions will continue in effect.

If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.

You may not transfer your rights or obligations under these Terms without our prior written consent, except where applicable law permits otherwise.

We may transfer our rights or obligations in connection with a restructuring, sale or transfer of SeaBreathes, provided that doing so does not reduce your mandatory consumer rights.

These Terms, together with information presented to you before a purchase, the SeaBreathes Privacy Policy and any applicable app-store terms, govern your use of SeaBreathes.

Nothing in these Terms limits rights or remedies that cannot lawfully be excluded.
